CHARTER FOR ENTRY TO AND USE OF THE "BlaBla 4U" PORTAL ------------------------------------------------------ The portal management (hereinafter "the management" or "management") declares the conditions of use for the "BlaBla 4U" Portal to be as follows: GENERAL INSTRUCTIONS: -------------------- 1. Use of the portal is subject to all relevant laws, as amended from time to time, and to the portal's conditions of use, as amended from time to time by the management. 2. All visitors or entrants to the portal affirm by visit or entry acceptance of and full agreement to all the terms of this charter of conditions of use. 3. Data and details on the portal and linked or associated sites are for information purposes only. 4. Advertisements in the Employment and/or Offers &/or Employment Offers &/or other classified offers are open to women and men. 5. Content of all announcements and offers in all commercial display or classified sections are the sole responsibility of the body that placed the announcement/offer/notice. 6. Content of all advertisements of any type found in the portal are the sole responsibility of the person, company or organization which placed the advertisement. 7. Content of articles in information editions is the sole responsibility of the body publishing them. 8. Management reserves the right to disqualify &/or remove offers &/or notices &/or advertising notices &/or articles &/or in whole or in part, if it deems them: offensive, in poor taste, defamatory or libelous in general or in particular, invasive of privacy in general or in particular, &/or hurtful in general or in particular, according to Law, customs & norms. USE OF PORTAL CONTENT --------------------- 1. The portal includes information, services, programming, graphics, images, links and other content (hereinafter "the contents"). The content is protected by all laws pertaining and inter alia the laws of copyright, trademark and all other rights protected by law, charter of the portal &/or any other or others. 2. Management is responsible for information, content or data included in the contents &/or the accuracy of these. Similarly, management is not responsible for any damage liable to be caused to any or others as a result of use whatsoever of the contents. 3. Use of the contents or any part thereof is intended solely for visitors' private use. It is illegal to modify or advertise the contents in any way, broadcast in any way, transfer in any way, sell, distribute or make any commercial use of the contents or any part thereof unless express permission is sought from and granted by management. CONTENT INTRODUCED TO THE NET BY USERS -------------------------------------- 1. The portal includes inter alia information banks, notice boards, forums, chat rooms, home pages and other applications, as they are today, and as they will be in future (hereinafter "applications") enabling users to enter onto the net written texts, images, content of various types, files of various types, information, links and other contents (hereinafter "user content"). 2. Users may not enter onto the net user content where placing these on the net is illegal &/or includes illegal content &/or are intended for illegal purposes &/or containing elements harmful to operation of the net. Thus users may not introduce the following to the net: 2.1 Content which is racist or may incite, insult, harass. 2.2 Content which may harm, insult, defame, or offend rights and religions. 2.3 Content including viruses capable of causing any damage to the net &/or to users. 2.4 Content including commercial or advertising elements, without express prior permission of management. 3. Users are permitted to introduce to the net only user content which belongs to them &/or content whose owners provided express prior written permission to introduce same to the net. Introduction of content to the net by a user constitutes a declaration that to the best of his/her knowledge introduction of said content to the net is not: illegal, and in particular does not contravene laws of copyright &/or constitute a violation of any rights of third parties, and also that said content contains nothing harmful or likely to harm any person &/or defame &/or likely to defame any person, any body or any other or others, as provided by the Anti-Defamation Law of 1965 &/or the Protection of Privacy Law 1981 or any other Law. 4. Management does not inspect and cannot inspect user content introduced to the net by users via application programs, and is not responsible in any way or shape for said content. Total responsibility, according to all Law and to all and sundry arising from the introduction of said content to the net, resides solely with the user or users who introduced the content. The user or users will bear the legal consequences of any and all Law in respect of content introduced by them. The users &/or user indemnify(ies) and compensate(s) management for any complaint &/or demand &/or claim proffered against management in regard to content introduced by users to the net. 5. Notwithstanding the aforesaid, management reserves the sole right and obligation to edit &/or remove user content which in its judgement appear: to violate any Law, custom or usage &/or are of undesirable character or specifically damaging &/or violate the Charter of use for the net &/or whose introduction into the net are prohibited. Management reserves the sole right to limit or to prohibit entry to and use of the portal to users who: violate the Law &/or the conditions of use of the net &/or do not honour the rights of other users of the net &/or disturb correct functioning of the net in whatever manner. 6. Introduction of user content by any user to the net empowers management with authority to publish and to use the user content in any manner according to its sole discretion. By introducing user content to the net a user advises and consents to this empowerment of management with the aforesaid authority. CHAT FORUMS: ----------- The portal's forum network provides a stage for expression of opinion on specific areas and subjects. The forums facilitate unmediated meetings on matters of mutual interest between users worldwide. The forums serve all, subject to management oversight. Oversight does not refer to interference with participants' right of free expression, but does refer to the principle of one moderator. Because the forums serve all participants, announcements irrelevant to the subject of the forum [hereinafter "off-topic"] &/or offensive to participants in general shall be removed by the portal's forum managers. Users / participants are requested to observe the following: ----------------------------------------------------------- 1. To avoid posting many notices on the same subject, whether to one or many forums (hereinafter "spamming"), and similarly the posting on &/or forwarding to forum of miscellaneous unsolicited off-topic &/or offensive notices [hereinafter "junkmail" &/or "trashmail"]. 2. To avoid absolutely rude or vulgar language and to avoid personal insults or to send messages whose sole purpose is personal attack. Such messages will deemed off-topic and removed forthwith. 3. To avoid introducing to the forum any file likely to harm, obscure, modify or transfer information files used unknowingly by the user. 4. Deliberate introduction of a virus to the portal will be prosecuted according to Law. 5. Forum management reserves the right to remove content which appears in its judgement to contravene the law &/or violates copyright &/or contravenes a legal ban on publication or which may disturb the correct functioning of the forum, all the preceding according to the judgement of the management. 6. Introduction of content to the forums empowers the portal with authority to publish or use said content in any manner it may select, solely according to its own judgement and without remuneration. Users introducing content to the forums in so doing advise and consent to this article. 7. As has been alluded to, management's oversight is in principle limited and does not constitute censorship. Management cannot oversee all forum discussions or all content introduced to them by participants, therefore management is in no way responsible for such content. Responsibility for content introduced to forums resides solely with the user introducing them. 8. Whereas it is not possible to ensure absolute security of systems, users are advised to avoid introducing to forums or to transfer via forums any information if divulged is liable to cause them harm in any way. In order to avoid harassment resulting from publication of telephone numbers, addresses or other identifying information, users are advised to avoid the transfer of such information in the framework of the forums. At its sole discretion, management reserves the rights to remove any notice or message containing such information. 9. It is hereby made clear: in any case in which management is required by any authority and according to all law, for example the Courts, to provide evidence &/or information available to it, including addresses in its possession, portal management shall act according to the law and provide the required information. 10. Management reserves the right to gather statistical information in regard to participation in forums and rates of participation in forums in order to improve the portal's range of services &/or for specific purposes of advertising &/or other commercial purposes. 11. We deem it correct to especially emphasize that replies provided by experts participating in forums constitute solely general information, advanced only and exclusively upon the basis of general information provided by the questioner, without fundamental, intensive and close examination of the case. Such expert replies should not be regarded as directives or prescriptive advice. All action should be preceded by expert consultation involving close examination to prescribe a course of action. PRIVACY: ------- 1. Management meticulously guard privacy of portal users, in particular personal details disclosed by users themselves. Use of the portal is anonymous, and management has no access to users' personal details. 2. Whereas it is known that no system in existence is absolutely secure, users are requested not to introduce to the net or to transfer via the net information liable if divulged to cause them any kind of harm. 3. It is hereby made clear and explicit: in any case in which management is required by any certified authority operating under sanction of law and according to legal warrant to provide evidence &/or any information found in its possession, management shall act according to the law and shall provide the information required. 4. It is hereby made clear and explicit: management is empowered to gather information in regard to use and rates of use of the portal and the net, and at its discretion to make use of such, inter alia, for improvements of services it offers &/or for specific advertising purposes &/or other commercial purposes.
